This document contains important information regarding your rights and obligations and conditions, limitations, and exclusions that might apply to you. By placing an order for products or services from this website, you agree to be bound by these terms and conditions.

You may not order or obtain products or services from our website if you (a) do not agree to these terms; (b) are under 18 years of age or the legal age to form a binding contract with With Faith and Love, or (c) are prohibited from accessing or using this website or any of its contents by applicable law. 

These terms and conditions apply to the purchase and sale of products and services through www.withfaithandlove.com pages, accounts on Facebook®, Pinterest®, Creative Market®, and Etsy® (the “Sites”).

Please take a few minutes to read my Terms of Use carefully, my Privacy Policy, and these Terms. You agree to be bound by these Terms by using any of the Sites. We may change these Terms occasionally, so please periodically check here for updates. We will update the date at the top of this document each time I make changes. You are responsible for reviewing any changes to the terms. Any purchase of products or services available through this Site signifies your acceptance of and Agreement to any changes. To assist you in understanding and complying with these Terms, the most recent revision date is listed above.

Order Acceptance, Cancellation, and Refunds.

You agree that your order is an offer to purchase the products and services listed in your order under these Terms. The delivery of any files to you constitutes acceptance of your order and, therefore, the creation of a contractual agreement between you and With Faith and Love. We may refuse any order at our sole discretion. Once your order has been received, we will send you an email confirmation with your order number and details of the items you have ordered. The contract of sale between With Faith and Love and you will not take place unless and until you have received your order confirmation email. All partial payments agree to the following terms and agree that no products will be shipped until full payment has been received.

Pricing & Payment Terms

3.1 All prices posted on this website are subject to change at any time without notice. The cost of the product or service you purchase is set out in your order confirmation email and will be the price in effect when the order is placed. If price changes are made, they will not apply to orders placed before the adjustment. Pricing does not include taxes or charges for shipping and handling. We are not responsible for pricing, typography, or other errors in our website offer. We reserve the right to cancel any orders arising from such errors

3.2 We reserve the right to accept or reject any order for any reason. We must receive payment before we take your order. By providing credit card information to us, you represent and warrant that the data is accurate, correct, and complete. You are authorized to use the credit card for the purchase.

We do not offer refunds on any products designated as non-returnable, including but not limited to all website and social media templates. All sales are final because it is impossible to return a digital product.

If With Faith and Love, in its sole discretion, a refund may be appropriate for any intangible products from withfaithandlove.com, including website templates, social media templates, and so forth, you recognize and agree that you are requesting a refund on a product that you already have and cannot physically return.

Therefore, you also agree that if we allow you to return an item, we may charge you a twenty percent (20%) penalty fee in addition to the price of each item we can prove you have opened, downloaded, or unzipped.

If you wish to return a previously purchased intangible item and incur the fee, contact With Faith and Love within five days and enter a separate agreement.

Payment Plans

If you choose the Payment Plan option, you are required by law to complete all remaining payments of your plan.

Canceling or voiding these payments is not possible.

You agree that you do not own the single-use product license or receive the product (or files) until all fees are paid in full. If payment is not made by the due date, a $50 late fee will be assessed and charged within three days of that date. If payments are delinquent beyond 45 days, we will submit your account to collections and require you to remove any digital assets you do not legally own.

Semi-Custom Brands

As a customer, you agree that your purchase is final and will not be refundable. Because of the nature of the product and the time required for customizations, you agree that it can take up to 3 months for an open date. We try to accommodate your schedule and will do our best to get you in sooner if booked out far in the future.
Revisions
Semi-custom brands receive ONE (1) round of revisions on their overall brand. Upon approval of the brand overview, any changes beyond that point will be billed separately.

Intellectual Property Infringement Claims

The Parties agree that the Customer shall ensure that the trademark(s) does not infringe upon any third party intellectual property rights. Accordingly, the Customer knowingly assumes this risk.

In the event of an intellectual property infringement action arising from a third party claim, to the fullest extent permitted by law, Customer agrees to indemnify, save, and hold harmless With Faith and Love. from any damages, liabilities, costs, losses, or expenses arising out of any such third party claim, demand or action.

LIMITED WARRANTY

We warrant that the products purchased from our Site during the warranty period will be free from defects in materials and craft. We also warrant that the services purchased from our Site during the warranty period will be performed by generally recognized industry standards for similar services.

The duration of implied warranties, including without limitation the warranties of merchantability and fitness for a particular purpose, will be limited to the period stated in this warranty.

Intellectual Property Use and Ownership.

You acknowledge and agree to the following:

  1. All products and services on this Site are available for licensing, not sale. Each product or service is subject to the terms, conditions, and restrictions of the specific license agreement posted with/made available through a link accompanying the display or description of that product or service.

  2. You agree to comply with all terms and conditions of the specific license agreement for any product or service you obtain through this Site, including but not limited to confidentiality obligations and restrictions on resale, use, reverse engineering, copying, making, modifying, improving, sublicensing, and transfer. You will not encourage or allow others to violate the terms of these product and service license agreements.

  3. With Faith and Love will remain the sole and exclusive owner of all intellectual property rights in and to each product and service made available on this Site. You will have no ownership or proprietary rights in or to the products or services made available through this Site or to any intellectual property relating to those products or services.

  4. Fonts used in products are free for use, and all demo images and photography/video graphics must be replaced before launch. Fonts can be replaced within any template with the purchase of a license.

  5. Returns and Refunds.

    We do not offer refunds on any products designated as non-returnable, including but not limited to all website templates, social media templates, and any other intangible products. All sales are final.

  6. If With Faith and Love determines that a refund may be appropriate for any intangible products from www.withfaithandlove.com, including website templates, you expressly recognize and agree that you are requesting a refund on a purchased product. Therefore, you also agree that if With Faith and Love grants you a return of merchandise, they may charge a twenty percent (20%) penalty fee in addition to the cost of each item they can prove you have downloaded, unzipped, or viewed.

  7. Limited Warranty 

    We warrant that the products purchased from our Site during the warranty period will be free from defects in materials and craft. We also warrant that the services purchased from our Site during the warranty period will be performed by generally recognized industry standards for similar services.

    The duration of implied warranties, including without limitation the warranties of merchantability and fitness for a particular purpose, will be limited to the period stated in this warranty.

  8. Privacy

    We respect your privacy and are committed to protecting it. Our Privacy Policy explains how we collect, use, and share personal information when you purchase from our Site.

ADDITIONAL TERMS AND CONDITIONS

GOVERNING LAW

The parties have entered into this Agreement in the City of Pasig and agree that its validity, interpretation, and legal effect shall be determined under the laws of the Philippines, without regard to conflicts of law principles that would dictate the application of another jurisdiction’s laws. In the event of any action or proceeding arising out of, relating to, or concerning this Agreement, or litigation arising from the terms and conditions of this Agreement, including, without limitation, any claim of breach of contract, the laws of the Philippines shall govern, and venue will be located in the Regional Trial Court of Pasig.

Binding Effect

This Agreement shall be binding upon the Parties hereto and inure to the benefit of their successors, executors, heirs, representatives, administrators, and permitted assigns. The Parties have no right to assign this Agreement by operation of law or otherwise.

Indemnification

Both Customer and Company agree to defend, indemnify, and hold harmless the respective party from any liabilities or expenses resulting from a breach of this Agreement.

All claims and disputes arising from or relating to this Agreement will be settled by binding arbitration in the City of Pasig or another mutually agreeable location. A court of competent jurisdiction may confirm any arbitration award.

Entire Agreement

This Agreement constitutes the entire understanding between the Parties concerning its subject matter and supersedes all prior written or oral agreements.

This agreement supersedes all prior written and oral agreements regarding the subject matter of this document, and the terms and conditions of this agreement cannot be modified without the express written consent of both parties. The terms of this agreement shall be binding upon you, your representatives, successors, and assigns unless otherwise noted herein.
Equitable Relief

In the event that you violate or threaten to violate With Faith and Love intellectual property rights or confidential and proprietary information, we may seek injunctive relief in any court having jurisdiction over the matter. In addition, we may seek any interim, equitable, provisional, or injunctive relief necessary to protect our rights and property pending the outcome of the arbitration referenced above.

By agreeing to these terms, you agree to the personal and subject matter jurisdiction of the Philippines for any legal action taken by With Faith and Love.

Compliance With Law

The parties shall comply with all applicable laws and regulations in performing this agreement. The law shall prevail if there is any conflict between the terms of this Agreement and any law.

NO WAIVER

If one provision of this agreement is waived, that does not mean that any other provision is also waived. The party seeking to have the waiver apply must have signed a waiver in writing.

FORCE MAJEURE

In the event of a disaster or other emergency, either party may choose to terminate its contractual obligations. Such events include acts of God (fires, explosions, earthquakes), war or invasion by foreign enemies, embargoes or hostile acts (whether declared or not), riots or civil disorder, nuclear leaks, and explosions, and terrorist acts.
